Shouldn't the Mason County Drain Commissioner also seek legal advice about the consequences of proceeding with a Lake Improvement Plan and a Special Tax District formed by a Board that is not composed according to law. The statue clearly states that the Board shall include representation from all counties and local units of government affected by the lake improvement project and without Oceana County and Pentwater Township on board, any action they take could be considered null & void. A lawsuit brought upon the current formation could also jeopardize the tax roll.
