Hard to gauge how culpable the driver of the vehicle was in this accident without more facts, but use this incident to reinforce the common sense notion of walking on the road against traffic and to stay alert at what oncoming traffic is doing, so that you can get out of harm's way if they fail to see you. This is particularly important if it's dark, the roads are slick, and the speed limit of the road is high-- all of which could have been a factor here.
